1. Acceptance of Terms

By accessing or using Sage In Place's home monitoring service ("Service"), including our website, mobile applications, sensors, and related products, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you ("User," "you," or "your") and Core One, LLC, doing business as Sage In Place ("Sage In Place," "Company," "we," "our," or "us").

Sage In Place provides non-medical, non-emergency home activity monitoring and caregiver-notification services. The Service is intended to support daily living and provide peace of mind, not to replace medical care, emergency response systems, or 911 services.

2. Service Description

Sage In Place provides a home activity monitoring system consisting of:

  • Smart sensors (motion, door/window, temperature, light, bed, smart plug)
  • Activity pattern monitoring and insights
  • Configurable alert notifications
  • Notifications sent via SMS, email, or in-app messages to designated contacts
  • Web and mobile applications for dashboards and control

Our Service requires an active, stable internet connection in the monitored home. Without internet connectivity, sensors cannot transmit data and notifications cannot be delivered.

Our Service helps families stay informed about daily routines. Sage In Place does NOT contact 911, emergency responders, or medical professionals on your behalf.

3. User Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Have legal authority to enter a binding agreement
  • Provide accurate information
  • Use the Service only for its intended purposes

If you use the Service on behalf of another person (e.g., a family member), you confirm that you have authority to do so.

4. SMS Communications & 10DLC Compliance

4.1 SMS Consent

By providing your mobile number, you agree to receive SMS notifications for:

  • Activity alerts
  • System status updates
  • Billing and account communications
  • Support-related messages

4.2 10DLC Compliance

Our messaging follows carrier and industry guidelines.

  • Message frequency varies based on your settings
  • Standard carrier rates may apply
  • Reply STOP to unsubscribe; HELP for assistance

4.3 Notification Disclaimer

SMS alerts are notifications only. Opting out may limit our ability to notify your designated contacts.

5. Subscription, Billing & Refund Policy

5.1 Subscription Plans

Service is offered through monthly and annual subscription plans. Current pricing is posted on our website.

5.2 Payment Terms

  • Subscriptions are billed in advance
  • You authorize recurring charges to your chosen payment method
  • Fees are non-refundable except as described in Sections 5.3–5.5

5.3 30-Day Full Refund Guarantee (Hardware + Subscription)

If you cancel your Service within 30 days of initial activation or hardware purchase:

  • You receive a full refund of the $149 hardware fee
  • You receive a full refund of any subscription fees paid (monthly or annual)
  • Hardware must be returned in original working condition

5.4 Refunds After the First 30 Days

Monthly Subscriptions

  • Service remains active through the current billing period
  • No refunds issued for prior monthly payments

Annual Subscriptions — Monthly Rate Adjustment Refund

If you cancel an annual plan after 30 days:

  1. We calculate used full months
  2. Each used month is valued at the standard $49 monthly rate
  3. That amount is deducted from the annual fee paid ($499)
  4. The remaining balance (if positive) is refunded

If the result is zero or negative, no refund is issued.

5.5 Refund Processing

  • Refunds are returned to the original payment method
  • Processing may take 5–10 business days
  • Processor fees may be non-refundable

5.6 How to Cancel

To cancel your subscription, email support@sageinplace.com or call (614) 382-2540 with the following information:

  • Caregiver Name
  • Resident Name
  • Address of Resident
  • Reason for Cancellation

6. User Responsibilities

You agree to:

  • Install hardware according to instructions
  • Maintain Wi-Fi and power for the system
  • Provide accurate emergency-contact information
  • Keep login credentials secure
  • Respond to alerts as appropriate
  • Not misuse, tamper with, or attempt to reverse-engineer the system

7. Important Service Limitations

7.1 Not a Replacement for 911

Sage In Place is a notification service, not an emergency response system.
In any crisis or urgent situation, call 911 directly.

7.2 Limitations of Alerts

Delivery of notifications depends on:

  • Internet connectivity
  • Sensor functionality
  • Mobile carrier availability
  • User device settings

We do not guarantee delivery times or successful receipt of notifications.

7.3 Not a Medical Service

  • We do not diagnose medical conditions
  • We do not monitor vital signs
  • We do not provide professional healthcare services

Individuals with medical needs should maintain dedicated medical alert or healthcare systems.

8. Privacy & Data Protection

Your data is handled according to our Privacy Policy, which explains:

  • What data we collect
  • How it is used
  • How it is protected
  • Your rights regarding personal information

By using the Service, you consent to our data collection and processing practices.

9. Intellectual Property

All software, hardware designs, algorithms, and content are owned by Sage In Place. You receive a limited, non-exclusive license to use the Service during your subscription.

10. Service Availability

We strive for high uptime but cannot guarantee uninterrupted service. Availability may be affected by:

  • Maintenance
  • Internet outages
  • Third-party provider issues
  • Hardware failures
  • Events beyond our control

We will provide notice of scheduled maintenance when feasible.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability is limited to the fees you paid in the prior 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • We disclaim warranties of merchantability and fitness for a particular purpose
  • We do not guarantee delivery or receipt of notifications

You assume all risks associated with using automated monitoring technology.

12. Indemnification

You agree to indemnify Sage In Place against claims arising from your misuse of the Service or violation of these Terms.

13. Termination

13.1 Termination by You

You may cancel at any time. Refunds follow Section 5.

13.2 Termination by Us

We may terminate service for:

  • Violation of Terms
  • Non-payment
  • Fraud or abuse
  • Other valid business reasons

13.3 Effect of Termination

  • Access to the Service ends immediately
  • Hardware must be returned if within the 30-day window
  • Refunds, if any, are governed by Section 5
  • Account data handling follows the Privacy Policy

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Ohio. Disputes will be resolved via binding arbitration on an individual basis.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

16. Severability

If any provision is invalid, remaining provisions remain in effect.
